INSURANCE BAD FAITH: REFUSAL TO PAY UNDERINSURED MOTORIST BENEFITS Underinsured motorist coverage (also known as UIM coverage) is typically available as optional insurance when you purchase an automobile insurance policy. UIM insurance provides benefits when the driver at fault for an accident does not have sufficient insurance to cover all of an injured party’s losses. The availability of underinsured motorist coverage varies from state to state. In some states, like Pennsylvania, you have the option to “stack” underinsured motorist coverage. Stacking UIM insurance means that you multiply the amount of coverage you have by the number of vehicles insured on your policy. The option to stack UIM insurance must be purchased in advance.
As drivers, we pay our UIM premiums with the expectation that we will be protected in the event of an accident. Unfortunately, some insurance companies do not keep their end of the bargain. When an insurer wrongfully refuses to pay benefits, offers only reduced benefits or delays payment of benefits, this is known as bad faith. Given the varying standards for UIM coverage, and insurers’ efforts to deny or minimize UIM payouts, you need an experienced trial lawyer on your side. Our dedicated insurance attorneys can help you secure all of the compensation to which you may be entitled. Your insurance company is obligated to honor your insurance contract; when the insurer fails to do that, we can help.
