INSURANCE BAD FAITH: REFUSAL TO PAY UNINSURED MOTORIST BENEFITS

Feldman Shepherd Bad Faith Insurance Uninsured Motorist CoverageAccording to the Insurance Research Council, approximately 10 percent of drivers in Pennsylvania and New Jersey are uninsured. Because there are so many uninsured drivers on the road, many of us purchase uninsured motorist coverage (also known as UM coverage) with our automobile insurance policies. In some states this coverage is mandatory. Uninsured motorist coverage provides benefits when the person at fault in an automobile accident has no insurance. Also called uninsured motorist insurance or UM insurance, these policies may pay for medical bills, lost wages, pain and suffering and other losses arising out of an accident in which an uninsured driver is at fault. In some states, like Pennsylvania, you have the option to “stack” uninsured motorist coverage. Stacking UM insurance means that you multiply the amount of coverage you have by the number of vehicles insured on your policy. The option to stack UM insurance must be purchased in advance.

As drivers, we pay our UM premiums with the expectation that we will be protected in the event of an accident. Unfortunately, some insurance companies do not keep their end of the bargain. When an insurer wrongfully refuses to pay benefits, offers only reduced benefits or delays payment of benefits, this is known as bad faith.
