Preliminary Approval Granted for Ivy Industrial Park Class Action SettlementJanuary 23, 2009 UPDATE - January 23, 2009: The Court has granted premlinary approval to the Class Action Settlement.
PHILADELPHIA (January 16, 2009) - The law firm of Feldman, Shepherd, Wohlgelernter, Tanner, Weinstock & Dodig today announced that it has filed a motion with the U.S. District Court for the Middle District of Pennsylvania to approve a class action settlement agreement in a case between property owners and residents living near the Ivy Industrial Park in Clarks Summit, Pennsylvania and a group of companies that operate or once operated businesses within the Park. This settlement is related to groundwater contamination in the Industrial Park.
If the Court approves the settlement agreement, property owners and residents living in the area affected by groundwater contamination will receive a Notice of Proposed Settlement which outlines the steps they must take to be included in or opt out of the settlement. These residents will have 60 days from the mailing of the Notice to decide whether or not to participate. A.B. Data, Ltd., the Class Administrator, will be responsible for mailing the Notice of Proposed Settlement directly to property owners, establishing a toll-free telephone number with live operators to assist property owners with the required paperwork, and coordinating an outreach program within the community to inform property owners of the settlement.
By participating, property owners will be eligible for monetary compensation which could be used to pay water bills related to a planned public water line and for other purposes. The line itself would also be paid for by the defendants in the case.

Final approval of the settlement will be considered at a Fairness Hearing, which will be held before the District Court judge sometime after the 60 day response period.
