Tanner will address bad faith cases against insurance carriers and in particular, obtaining and keeping punitive damage awards. As an example, Tanner will discuss a $7.9 million bad faith federal jury verdict against an insurer, which was considered to be the largest in Pennsylvania history. In the Jurinko vs. The Medical Protective Co., Tanner’s client was awarded more than $7.9 million - including $6.25 million in punitive damages - in a doctor's claim that his insurer's failure to offer the limits of his policy in a medical malpractice action led to a $2.5 million medical malpractice verdict against him for allegedly failing to diagnose Stephen Jurinko's skin cancer.
