MEDICAL MALPRACTICE

OUR EXPERIENCE

In 2012, Feldman Shepherd attorneys Daniel S. Weinstock and G. Scott Vezina secured a $78.5 million verdict for a three-year-old child from Pottstown, Pennsylvania who suffers from severe spastic quadriplegic cerebral palsy as a result of medical negligence during birth. The obstetrician in this case performed a bedside ultrasound with antiquated and improperly maintained technology, which led him to conclude that the baby had died in the womb. After insisting that the baby had come “back to life,” he hurriedly performed an emergency cesarean section delivery that he should have performed over eighty minutes earlier. This fateful delay resulted in massive brain damage in the infant. The multi-million-dollar award includes payments for the child’s future medical care, lost earnings, and pain and suffering for both the child and its mother.

In another case, Feldman Shepherd attorney Mark W. Tanner represented a forty-two-year-old New Jersey man who was born with spondylolisthesis, a spinal condition which can  cause chronic back and leg pain. He decided to undergo a lumbar spinal fusion procedure, which his doctor explained would allow him to return to work without pain. However, the surgeon utilized improper spinal implants, and ultimately rendered his spine unstable, making this patient’s situation considerably worse than before surgery, and resulting in a need for two additional spinal surgeries in an effort to repair the damage.   At trial, a jury decided that the original procedure was both unnecessary and improperly performed, and after a three-hour deliberation, the jury returned a $22.4 million verdict for our client and his wife.

Our attorneys also handle dental malpractice cases. Carol Nelson Shepherd and Patricia Giordano represented a thirty-eight-year-old father of two who suffered an abscessed tooth. He went to an oral surgeon who, instead of ordering a CT scan and admitting him to the hospital, told him to return later for extraction. He later went to the emergency room complaining of pain, fever, chills, swelling, and an inability to open his mouth fully. Again, his care providers failed to admit him and perform CT scans. The next day, our client was not breathing and non-responsive, and by the time he was resuscitated his brain had suffered severe oxygen depravation. After two years of hospitalization, rehabilitation, and nursing home care, he now suffers from permanent limb weakness, is largely confined to a wheelchair, and has difficulty speaking. Shepherd and her associates secured a $4.5 million verdict, which will help to cover medical costs associated with his injuries.
