$5.75 Million Settlement of Pittsburgh, Pa Birth Injury Case

In August 2011, attorneys Daniel S. Weinstock and Andrew K. Mitnick obtained a $5.75 million settlement of a Pittsburgh birth injury case.

The case involved a woman who was 41 weeks pregnant and came into the hospital for induction of labor. Attorneys Weinstock and Mitnick argued the fetal monitoring strips demonstrated the baby was not tolerating the labor well, and that a cesarean section should have been performed before the baby’s intolerance of labor led to a catastrophe. After several hours of delay, the mother experienced an amniotic fluid embolus, which quickly led to devastating neurological injury to the baby.

The settlement is expected to be sufficient to take care of the child’s life-long medical and other care needs. The defendants have insisted on confidentiality as a requirement of settlement.
