PRODUCT LIABILITY: CHILDREN’S PRODUCTS When we purchase items for our children that are age-appropriate and made by a reputable manufacturer, we assume they will be safe. Many times, however, seemingly safe products pose serious dangers to our little ones. During 2007 alone, recalls of children’s products doubled and injuries from recalled children’s items jumped 374 percent. That year, the Consumer Product Safety Commission (CPSC) recalled 231 children’s products, accounting for more than 46 million units. According to the nonprofit organization Kids In Danger, the recalled products caused nearly 660 injures and six deaths. Almost half of the products were toys, with toy recalls totaling more than 30 million units. The remaining recalled children’s products included clothing, footwear, furniture, books, games, strollers and car seats.
In 2008, several consumer groups, including the Consumer Federation of America, Kids In Danger and Public Citizen, joined forces seeking CPSC reforms. In their report, “Total Recall: The Need for CPSC Reform Now,” the groups cited data indicating that children’s products recalls continued to climb during the first six months of 2008. Further, the groups emphasized that toys and other children’s products sold in the United States were not subject to any pre-market government testing. Despite the later passage of more stringent consumer product safety legislation, children’s product recalls continue with alarming regularity. In fact, six children’s products recently topped CPSC’s “Most Wanted” list.
