Bucks Day Care Owner Acquitted In Death (WTXF Fox 29)

A suburban Philadelphia jury has acquitted a day care owner of involuntary manslaughter and other charges in the death of a toddler left in a hot car for more than seven hours last summer.

Rimma Shvartsman, 47, broke down in tears Monday after jurors announced their decision, which followed about 8 1/2 hours of deliberations.

Prosecutors said Shvartsman was guilty of "a mistake that had dire consequences" when she left 2-year-old Daniel Slutsky in the car in July outside the day care she co-owned in Penndel, about 20 miles northeast of Philadelphia.

But defense attorney Michael Mustokoff said "not every accident is a crime." He said the lapse was due to stress, lack of sleep,and an atypical routine.

The parents of a toddler who died from being left in a hot van for more than six hours outside a Philadelphia-area day care center are suing the center and its owners.

In July, the parents of 2-year-old Daniel Slutsky, Gil and Lyudmila Slutsky, said they would sue Fairy Tales Daycare Center in Penndel over the July 1 death.

Their lawyer, Daniel Weinstock, said in July that the suit was to draw attention to the problem and make sure similar deaths won't happen in the future.

"Mr. and Mrs. Slutsky obviously understand that brining civil action is not going to bring Daniel back, but what they are hoping to do is to bring attention to this situation which occurs mmore often than it should," says Daniel Weinstock, the parents' lawyer.
