CLASS ACTIONS: ANTITRUST In a class action lawsuit, a large number of people with similar legal claims join together in a group (the class) to sue someone, usually a company or organization. When we talk about class action lawsuits in the context of antitrust violations, we are referring to a group of consumers who have been harmed by the anti-competitive conduct of one or more companies. Examples of anti-competitive conduct include price fixing, which means agreeing to set the price at which goods or services will be sold; monopolies, whereby one or more companies control the sale or supply of a particular commodity; tying, which means linking the purchase of one product or service to the purchase of a second product or service; and price discrimination, where a company offers the same commodity to similarly situated consumers at different prices. When businesses behave in this manner, the marketplace suffers and consumers are left to bear the burden of inflated prices and unfair expenditures.
The federal government has enacted a number of laws to protect consumers by prohibiting such unfair restraints of trade. Examples include the Sherman Antitrust Act, the Clayton Act and the Robinson-Patman Act. In some cases, plaintiffs may be entitled to “treble damages,” meaning they may recover three times the amount of the actual damages they have suffered. In addition to federal law, various state laws have also been designed to safeguard the free flow of goods and services.
