CLASS ACTIONS

Class Action Suits Feldman Shepherd Personal Injury AttorneysA class action is a lawsuit in which a large number of people with similar legal claims join together in a group (the class) to sue someone, usually a company or organization. Common class actions involve cases in which a product has injured many people, where a company has wrongfully overcharged for a product or service, or in which a group of people has suffered discrimination at the hands of an organization.

Sometimes, a case does not qualify as a class action but it does qualify as a mass tort. There are similarities in that there are still a large number of people who have been similarly injured by the same negligent acts or the same defective product. Examples of mass tort litigation include cases involving medical devices, such as orthopedic hip replacements, breast implants, pacemaker wires, and latex gloves. Other examples include a wide range of consumer products, such as prescription drugs, food supplements, tires, or household products, and disasters such as airplane crashes. Mass torts in business law can include civil RICO violations, fraud and misrepresentation, breach of fiduciary duty, defamation, wrongful interference with business, and violations of good faith and fair dealing.

One distinct advantage of class actions and mass tort litigation for the injured party is that one personal injury attorney or group of personal injury attorneys can represent many persons at the same time. This is very cost-effective, since all the investigative and preparation work done for one can be used by the others. Often a network of personal injury attorneys across the country will work together by sharing information and responsibility for the work required to successfully represent their clients.

If you feel that you and other individuals you know are a victim of consumer fraud, product liability, securities fraud, unfair wage compensation, environmental or toxic claims, or antitrust matters, you may be entitled to raise a class action suit to get fairly compensated for your suffering. We also represent groups of unfairly treated workers, which include employees of any business who feel that their constitutional rights have been violated.

Class actions are often brought against corporations who overcharge or otherwise mistreat many customers in the same way. They are also brought against manufacturers of defective products. A class action lawsuit may also be brought against a company or its officers on behalf of a class of shareholders in the company. Examples include:

  • Antitrust law violations
  • Defective drugs
  • Defective products
  • Employment discrimination
  • Environmental claims
  • Securities fraud
  • Utility companies, credit card issuers, and banks overcharging customers
  • Wrongful billing practices

The class action provides a useful mechanism for prosecuting the claims of many persons whose injuries added together are significant, but which individually would not be large enough to justify the expense of bringing the individual lawsuits.

Handling each group as a special and unique case, Feldman Shepherd lawyers have obtained substantial verdicts and settlements in class action litigation, in state and federal courts. We have successfully pursued class action claims for health care fraud, claims by tenants of apartment complexes for unfair utility expenses, claims against car manufacturers for defective brakes, and cases against pharmaceutical companies for their distribution of unsafe drugs, as well as a variety of other class action cases.

Our experienced attorneys can help you secure all of the compensation to which you may be entitled. This may include compensation for your pain and suffering, financial losses, and emotional distress. In some cases, you may also be entitled to punitive damages for another party’s wrongdoing.

If you and other individuals believe you have been injured as a result of a faulty product or service, contact us today.
