CLASS ACTIONS A class action is a lawsuit in which a large number of people with similar legal claims join together in a group (the class) to sue someone, usually a company or organization. Common class actions involve cases in which a product has injured many people, where a company has wrongfully overcharged for a product or service, or in which a group of people has suffered discrimination at the hands of an organization.
Sometimes, a case does not qualify as a class action but it does qualify as a mass tort. There are similarities in that there are still a large number of people who have been similarly injured by the same negligent acts or the same defective product. Examples of mass tort litigation include cases involving medical devices, such as orthopedic hip replacements, breast implants, pacemaker wires, and latex gloves. Other examples include a wide range of consumer products, such as prescription drugs, food supplements, tires, or household products, and disasters such as airplane crashes. Mass torts in business law can include civil RICO violations, fraud and misrepresentation, breach of fiduciary duty, defamation, wrongful interference with business, and violations of good faith and fair dealing.
