Get To Know Carol |
A passionate litigator, Carol has limited her practice to representing patients in medical negligence claims for over thirty years. To her, it is the perfect combination of applying her extensive knowledge of diverse medical topics with using strong oral advocacy skills to prove her cases and win.
Both Carol’s mother and father were physicians, and she recalls as a small child tagging along with her family physician mom on hospital rounds and house calls. Then from age 11 until she went to college at age 18, she worked in her mother’s office. Her first-hand experience with patients and medical practice instilled in her both a fascination with medicine and an empathy for the concerns of patients.
While one of the highlights of her practice is taking apart a health care provider defendant on cross-examination at deposition or trial, Carol says her favorite part of practicing law is being able to provide a better and more comfortable future for her clients. She has worked with many individuals and families who have suffered an obstetric disaster, a delay in diagnosis or have lost a beloved family member as a consequence of medical negligence. Her clients and their families often stay in touch with her over the years.
When Carol began her legal career, she was daunted by the weighty responsibility to her clients who had placed their trust in her and, therefore, was driven to excel as a trial lawyer in every way. Presently, she says it is a desire to right a wrong, to obtain justice, sometimes to prevent the same mistakes from occurring again, and to provide for her clients and their families that motivate her to succeed.
A little known fact about Carol is that she is an aspiring writer and recently completed her first novel. She also loves to travel. In fact, Paris is one of Carol’s favorite places in the world where she dreams of having a pied-à-terre to pursue her fiction writing hobby.
Carol is also an avid culinarian and loves to cook for everything from barbeques at her beach home in Avalon to large family holiday dinners. She has placed second and third in the local “Cooking up Justice” competition which provides funding for Philabundance. Carol also appreciates contemporary art and crafts and supports many Philadelphia-area art shows, fairs and museums.
While the practice of law, helping others, writing and cooking are all things that feed Carol’s spirit, she is most proud of raising four wonderful children - all of whom are now successful adults. She recently married Thomas Backenstose, a dentist in Philadelphia, and inherited also his two lovely daughters.

Carol Nelson Shepherd was born in West Point, New York. She earned her bachelor’s degree in Sociology and English from Arizona State University in 1975 and her law degree from Syracuse University College of Law in 1978. In 1987, Ms. Shepherd became one of the founding partners of Feldman Shepherd, where she has devoted her practice to catastrophic injury claims arising from medical negligence.

Ms. Shepherd has represented clients in claims against health care providers arising from obstetric / childbirth injury, delayed diagnosis of cancer, improperly performed surgery, psychiatric malpractice and many other cases involving substandard medical care.
She has held prominent leadership positions in the regional and national legal communities, including serving as President of both the Pennsylvania and Philadelphia Trial Lawyers Associations, member of the Board of Governors and Chair of the Professional Negligence Section of the Association of Trial Lawyers of America, Chair of the Civil Litigation Section of the Pennsylvania Bar Association, as well as serving as a member of the Pennsylvania Bar Association’s House of Delegates.
She is a member of the Million Dollar Advocates and The National Trial Lawyers, Top 100 Trial Lawyers, and has been named as a Lawdragon 500 Leading Lawyers of America. She was honored to be inducted in 2006 as a Fellow of the American College of Trial Lawyers, and in 2010 as a Fellow of the Litigation Counsel of America.
From 2004 through 2013, Ms. Shepherd was named among the Top 50 Women Super Lawyers® in Pennsylvania, Top 100 Super Lawyers® in Philadelphia and Pennsylvania, and as a Pennsylvania Medical Malpractice Super Lawyer® by Thomson Reuters, published annually in Philadelphia magazine.
Just in the first half of 2011, Ms. Shepherd successfully resolved $26 million of cases, including the following:
$4.5 million after starting trial in a dental malpractice case in a suburban Philadelphia county.
$4 million obstetrics case in rural western Pennsylvania.
$1.2 million wrongful death case in New Jersey.
$4.25 million in a New York City obstetrics case.
$2 million settlement for woman in rural northeastern Pennsylvania county who suffered mild hypoxic brain injuries, including speech, vision and gait disturbances when her postpartum hemorrhage was not managed appropriately.
Ms. Shepherd also recently won the full policy limits in what is believed to be the first case in the United States where it was contended that the defendant's failure to prescribe periconceptual folic acid to a young woman resulted in the delivery of a daughter suffering from spina bifida.
Numerous other favorable results have either been subject to confidentiality agreements or appear in the section for the firm under the verdicts and settlements.
