DEFECTIVE MEDICAL DEVICES: BONE SCREWS

Feldman Shepherd Medical Malpractice Bone ScrewsAccording to members of the American Academy of Orthopaedic Surgeons, the ability to internally fix bones through the use of screws, plates, rods and the like was one of the most significant advances in orthopedic treatment during the 20th century. The academy reports that bone screws are used more than any other type of implant when surgically realigning and setting bones. Bone screws may also be used to shorten or lengthen abnormally sized limbs and to aid in the relief of back pain. Bone screws are not without risk, however. Defective bone screws have been known to weaken and break, causing extreme pain to the patient.

In 1997, medical device manufacturer AcroMed Corp. settled a class action lawsuit arising out of defective bone screws that surgeons were using to treat back pain. The large class (group of victims) that filed the lawsuit claimed that the screws broke after implantation into their spines, in some cases causing debilitating injuries. The lawsuit settled for $100 million.

If you or a loved one has been injured by defective bone screws, our experienced trial lawyers can help you secure all of the compensation to which you may be entitled. This may include compensation for pain and suffering, financial loss, emotional distress and medical expenses. In some cases, you may also be entitled to punitive damages for another party’s wrongdoing. Our dedicated personal injury lawyers can also help you deal with your insurance company, as well as the insurer of the other party or parties. The insurance companies have lawyers working hard to minimize their payouts; you need an attorney who will work just as hard for you.

At Feldman Shepherd, we are committed to helping our clients throughout Pennsylvania and New Jersey obtain the best possible recovery as expeditiously as possible. We are here to serve you with hard work, attention to detail and a caring approach tailored to your individual needs. If we may be of assistance to you, please do not hesitate to contact us today.
