$1.95 Million
settlement for motor vehicle accident victims
March, 2002
In a confidential settlement of lawsuits commenced in both
Pennsylvania and New Jersey, Feldman Shepherd attorney Alan
M. Feldman
recovered $1.95 million for a 30 year old woman and her two
young children, following an accident in New Jersey caused
by a careless truck driver. The woman sustained serious injuries,
including permanent damage to her trachea, which required
extended hospital and medical care, although she was able
to return to her former job making sandwiches in a delicatessen
six months after the accident. Her children recovered from
their relatively minor injuries.
After investigating the facts, Feldman decided that claims
should be made against both the trucking company and its driver
(who were amenable to suit in Pennsylvania) and for negligent
maintenance of the roadway where the accident occurred by
state and municipal authorities (which could only be litigated
in New Jersey). Accordingly, the firm pursued the unconventional
approach of filing lawsuits in both jurisdictions. Exhaustive
preparation of the cases in both jurisdictions brought about
the substantial recovery for mother and children. The settlement
was facilitated by a team of medical, vocational, economic
and life care planning experts assembled by Feldman Shepherd trial counsel.
