Feldman Shepherd and Francis Mailman Soumilas File Class Action Lawsuit Against Lloyd’s for Failure to Cover Business Income Losses in Pennsylvania Arising from the COVID-19 Pandemic

PHILADELPHIA – May 27, 2020 — The law firms of Feldman Shepherd Wohlgelernter Tanner Weinstock Dodig LLP and Francis Mailman Soumilas filed a class action lawsuit against Certain Underwriters at Lloyd’s, London (“Lloyd’s”) for the insurer’s refusal to pay for loss of business income arising from the COVID-19 pandemic and Pennsylvania’s civil shutdown orders.

The lawsuit was filed in the U.S. District Court for the Eastern District of Pennsylvania on behalf of Independence Restaurant Group (IRG), which owns and operates Independence Beer Garden in Philadelphia. IRG submitted to Lloyd’s an insurance claim for loss of business income and related losses under its “All Risk” policy, which, after more than 30 days, Lloyd’s did not cover and had communicated its intent to deny.

Through the lawsuit, IRG seeks to represent class members throughout Pennsylvania who own and/or operate businesses insured with Lloyd’s policies similar to its own. The lawsuit seeks a Declaratory Judgment to affirm that Lloyd’s policies provide coverage to the plaintiff and the class members for any current and future business personal property losses, loss of business income, and extended special business income losses as a result of the COVID-19 pandemic and/or related Civil Authority orders affecting the operation of their businesses due to physical loss or damage caused by the COVID-19 pandemic.
