$5 Million Verdict in Nursing Negligence Case

Attorneys John M. Dodig and Jason A. Daria obtained a $5 million verdict on behalf of a 50-year-old Port Richmond woman who suffered permanent brachial plexus injuries to her right shoulder after falling from a hospital bed while hospitalized at the Hospital of the University of Pennsylvania.

Dodig and Daria argued that the Hospital of the University of Pennsylvania nursing staff was negligent in leaving Diane Bugieda unattended in the upright position while in the Intensive Care Unit prior to her fall.

The jury awarded Ms. Bugieda $1 million for past pain and suffering and $3 million for future pain and suffering. The jury also awarded $30,000 on an annual basis for medical care from 2006 through 2038, as well as an award of $50,000 to her husband, Edward Bugieda, for loss of consortium.
